YOUTH PROGRAM COACH

LIABILITY WAIVER, RELEASE OF CLAIMS & ACKNOWLEDGMENT OF RESPONSIBILITIES

I, the undersigned, acknowledge that I am participating as a Youth Program Coach with the Derek Fisher Be Better Foundation (“Foundation”). I understand that my responsibilities may include coaching, supervising youth participants, leading athletic activities, conducting basketball drills, assisting with camps and clinics, supporting after-school programs, and participating in other Foundation-sponsored activities.

By signing this document, I acknowledge and agree to the following:

1. ASSUMPTION OF RISK

I understand that my participation in Foundation programs and activities may involve inherent risks, including but not limited to physical injury, illness, accidents, falls, collisions, or property damage. I voluntarily assume the ordinary risks associated with performing my coaching duties, including participating in athletic demonstrations, physical activities, and youth development programs.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by applicable law, I hereby release and discharge the Derek Fisher Be Better Foundation, its directors, officers, employees, volunteers, agents, sponsors, and affiliates (“Released Parties”) from claims arising from my voluntary participation in Foundation activities, including claims involving ordinary negligence where legally permissible.

This release does not apply to claims that cannot lawfully be waived, including claims involving gross negligence, reckless or intentional misconduct, or applicable workers’ compensation rights and benefits.

3. MEDICAL TREATMENT AUTHORIZATION

In the event of an injury or medical emergency, I authorize Foundation representatives to contact emergency medical services and assist in obtaining appropriate medical attention.

I understand that responsibility for medical expenses will be determined in accordance with applicable law, insurance coverage, and any available workers’ compensation benefits.

4. YOUTH SAFETY AND SUPERVISION RESPONSIBILITIES

As a Youth Program Coach, I acknowledge my responsibility to maintain a safe, respectful, and supportive environment for all youth participants.

I agree to:

• Follow all Foundation policies, procedures, and youth protection guidelines.

• Provide appropriate supervision during assigned program activities.

• Maintain professional boundaries with youth participants.

• Immediately report suspected abuse, neglect, harassment, bullying, injuries, or unsafe conditions in accordance with Foundation policies and applicable law.

• Follow emergency response and incident reporting procedures.

• Refrain from inappropriate physical contact, verbal misconduct, discrimination, or any behavior that could jeopardize participant safety.

• Complete all required training, background checks, and Live Scan fingerprinting before beginning assigned duties, as applicable.

5. CODE OF CONDUCT AND PROFESSIONAL EXPECTATIONS

I understand that Youth Program Coaches are expected to demonstrate professionalism, integrity, leadership, respect, and good sportsmanship.

I agree to represent the Foundation positively, follow instructions from authorized leadership, maintain appropriate communication with participants and families, and uphold the Foundation's mission and values.

Violations of Foundation policies or professional expectations may result in disciplinary action, including termination of employment or removal from Foundation activities, consistent with applicable law.

6. PHOTOGRAPHY AND MEDIA RELEASE

I grant permission for the Foundation to use photographs, videos, and other recordings of me taken during Foundation-sponsored activities for educational, promotional, marketing, and social media purposes without additional compensation.

This authorization applies only to my own image, likeness, and voice and does not authorize the use of a youth participant's image without appropriate consent.

7. EMPLOYMENT STATUS AND LEGAL RIGHTS

I understand that this waiver does not alter my employment classification, compensation, or any rights and protections provided under applicable employment laws.

If employed by the Foundation, I acknowledge that my position is at-will, unless otherwise provided by a valid written agreement or applicable law.

Nothing in this agreement is intended to waive legally protected employment rights or relieve the Foundation of obligations that cannot lawfully be waived.

8. ACKNOWLEDGMENT AND AGREEMENT

I certify that I have carefully read and understand this Liability Waiver, Release of Claims, and Acknowledgment of Responsibilities.

I understand the nature of my coaching responsibilities and agree to comply with the Foundation's safety standards, policies, and professional expectations.

I acknowledge that I am signing this document voluntarily.
